Terms of Service

By creating an account or using the Wyng platform ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and Eugen Koslowski, operating as a sole trader under German law ("we", "us", "Wyng").

Wyng is a dashboard that allows solopreneurs and independent creators to connect multiple websites and digital properties, aggregate analytics, and monitor performance in one place. Features may evolve over time; we will notify you of significant changes.

You must create an account via our authentication provider (Clerk) to use the Service. You agree to:

• Provide accurate and complete registration information.
• Keep your credentials secure and not share access with unauthorized parties.
• Notify us immediately at legal@usewyng.com if you suspect unauthorized access.
• Be at least 16 years old (or the minimum digital consent age in your jurisdiction).

You are responsible for all activities that occur under your account.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Upload or transmit malware, spam, or any harmful content.
• Use automated tools (bots, scrapers) against our platform without prior written consent.
• Misrepresent your identity or affiliation with any person or organization.
• Resell or sublicense the Service without prior written approval.

We reserve the right to suspend or terminate accounts that violate these rules.

Wyng allows you to connect third-party services (e.g., Google Search Console, Google Analytics) via OAuth. By connecting a service, you authorize Wyng to access and display data from that service on your behalf.

We request only the permissions necessary to provide the feature you enable. You can revoke access at any time through the connected service's own settings. We do not sell data retrieved from connected services.

Wyng is currently in early access. Paid plans may be introduced in the future. When billing is launched:

• Subscription fees will be billed in advance on a monthly or annual basis.
• Prices are stated in EUR and include applicable taxes where required.
• You may cancel your subscription at any time; access continues until the end of the paid period.
• No refunds are issued for partial billing periods unless required by law.
• We reserve the right to change pricing with at least 30 days' advance notice.

All software, design, trademarks, and content comprising the Wyng platform are owned by or licensed to us and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service for your own business purposes during the term of your subscription. You retain all ownership rights to your own data and content.

Nothing in these Terms transfers ownership of Wyng's intellectual property to you, and nothing transfers ownership of your data to us.

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You are responsible for ensuring that any data you upload or process through Wyng complies with applicable data protection laws, including GDPR if you process data of EU residents.

We strive for high availability but do not guarantee uninterrupted access. The Service is provided "as is" and may be temporarily unavailable for maintenance, updates, or reasons outside our control.

We reserve the right to modify, suspend, or discontinue any feature at any time, with reasonable notice where possible.

To the fullest extent permitted by law, Wyng is provided "as is" and "as available" without warranties of any kind, express or implied , including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that analytics data displayed through connected services is accurate, complete, or up-to-date , that data originates from third-party providers and is subject to their own limitations.

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €50.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if advised of the possibility.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, to the extent such limitation is not permitted under German law.

You agree to indemnify and hold harmless Wyng and its operator from any claim, damage, or expense (including reasonable legal fees) arising from your use of the Service in violation of these Terms or applicable law.

Either party may terminate the agreement at any time. You may delete your account through the dashboard settings. We may suspend or terminate your account if you violate these Terms, with or without prior notice depending on severity.

Upon termination, your right to use the Service ceases. We will delete your personal data in accordance with our Privacy Policy.

These Terms are governed by the laws of the Federal Republic of Germany. The courts of Germany shall have exclusive jurisdiction over any disputes arising from these Terms, subject to mandatory consumer protection laws in your country of residence.

For consumers in the EU: The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings but will consider requests on a case-by-case basis.

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you may terminate your account before the changes take effect.
